4 things on your “TO DO” list before going to Family Court

In Newcastle, you can expect to be stuck in court for about 18 months or more before the trial date.

To avoid the cost and delay of court proceedings, here are the 4 things you need to do before filing:

1. Obtain legal advice – obtaining advice early can help you understand what needs to be done to achieve a settlement, including:
a. Your rights and entitlements in a property settlement; and
b. What parenting arrangements are in the best interests of the children

2. In financial matters – exchanging full and frank disclosure of each party’s financial circumstances so that each of you understand the nature and effect of any settlement proposals

3. Correspond with the other party – which may include:
a. Notifying the other party of your intention to make a claim for property settlement and/or settle the arrangements for the children;
b. Making an offer of settlement, if appropriate; and
c. Inviting the other party to family dispute resolution

4. Attending Family Dispute Resolution – a type of mediation specially designed to assist parties resolve their disputes after their relationship has ended.
