Have you recently separated from your partner? Do you have property? Are you worried about how your superannuation will be affected by the break up of your relationship?
The Family Law Act provides a pathway for prospective parties and the Court to follow when determining how to divide property.
You, your partner and the Court will need to consider the value of the assets and liabilities of your relationship, the contributions (financial and otherwise) of each of you to that relationship, and the future needs of each party, and whether a proposed division is just and equitable.
In recent years, law makers have realised that much of a couple’s property is comprised of superannuation. Accordingly, the Family Law Act allows the Family Court to make orders transferring superannuation entitlements between the parties.
